ARTICLE 1 - Object

The general conditions of sale apply to all orders placed on the website www.dragees-braquier.fr.
The company Braquier reserves the right to adapt or modify at any time these terms and conditions .
In the event of modification, it will be applied to each order the general conditions of sale in force the day of the order.
The purchase of a product on the present site implies an acceptance without reserve by the buyer of these terms of sale, which the buyer acknowledges having read prior to his order.

ARTICLE 2 – Products

The products offered are those listed on the site www.dragees-braquier.fr, within the limit of stocks available.
The company Braquier reserves the right to modify at any time the assortment or composition of products .
Each article is presented with its complete description: capacity, composition, variations available. The photographs are as faithful as possible but do not engage the company Braquier in any way.
The sale of the products presented on the present site is destined to all the purchasers residing in the countries which fully authorize the entry on their territory of these products.

ARTICLE 3 – Price

The prices displayed on the products are displayed in Euros (€) and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.
Braquier reserves the right to change its prices at any time, but agrees to apply the rates in effect that you have been given at the moment of your order, subject to availability on this date.
The indicated prices do not take into account the expenses of delivery, invoiced in addition to the price of the products, according to the amount of the order (and the weight of the parcel. see "Delivery").
Product Availability
Our product offerings and prices are valid as long as they are visible on the site, within the limits of available stocks.
Braquier selects with great care the event boxes proposed but can not guarantee at any time the availability of these items. The company reserves the right to substitute another item, of equivalent quality and price, after express agreement of the customer. Otherwise, the refund of the sums paid may be requested by the customer.

ARTICLE 4 – Orders and payment methods

Electronic Signature (Law of March 13, 2000)

Order validation
The order validation date corresponds to the date of the order in case Payment by credit card online, and on the date of receipt of the check in case of payment by check.

Terms of payment and security

The customer can pay:

• By credit card: Payment is made on the secure banking server of our partner (CIC). This implies that no banking information about you passes through the site www.dragees-braquier.fr. Payment by credit card is perfectly secure; your order will be registered and validated upon acceptance of payment by the bank you have chosen. Your credit card data is encrypted using the SSL (Secure Socket Layer) protocol and never goes unencrypted over the network. Payment is made directly to the bank. Braquier has no access to these coordinates and does not keep them on its servers. They will be asked for each new transaction on our site.
• By check: Your order is reserved for 7 days. Beyond this deadline, without receipt of your check, the order will be canceled. Please note that the order will only be processed (confirmed, validated and shipped) upon receipt of your check, and validation of the receipt.

Retention of Ownership 

Products remain the property of Braquier until collection complete the order. However, upon delivery, the risks of the goods delivered are transferred to the customer.

Payment default
Braquier reserves the right to refuse to make a delivery or to honor an order from a consumer who has not totally and partially paid a previous order, or with whom a payment dispute is being administered.

ARTICLE 5 –Right to retract

In accordance with Article L221-18 of the Consumer Code, the buyer has a period of fourteen (14) days to exercise his right of withdrawal and return the products, at his own expense, to the following address :

This period runs from the day of receipt of the products ordered. If this period expires on a Saturday, Sunday or a holiday (or non-working day), it is extended until the next business day.
The customer returns the goods without undue delay, at the latest within 14 days communication of its decision to retract. (Article L221-21).
In accordance with Article L221-24, if the customer exercises his right of withdrawal, the company Braquier will refund the full amount paid, including delivery costs, at most late within 14 days after receiving the return of products.
Please note that, in accordance with Article L221-28, some products sold on the site www.dragees-braquier.fr are not subject to right of withdrawal: products made according to the customer's specifications, or customized products (boxes, labels).
Also, the company Braquier reserves the right to refuse the return of a product if it has been unsealed or not can be put up for sale for reasons of hygiene and health protection.

ARTICLE 6 – Terms of delivery

Reservations
When ordering, please ensure the accuracy of your details to avoid any delay in delivery, which could result in additional cost to you. All our deliveries are presented under packing and protected by an overpack for the shipments in France or abroad.
The parcels travel at the risks and peril of the recipients who will have, if necessary, proceed to reservations upon receipt, with the carrier.
For orders with a chocolate shell, it is fragile, thank you to check the condition of the shell when receiving the order.
Thus, any claim must occur at the time of delivery, and be mentioned on the delivery note. In other cases, packages will not be returned or exchanged.

Delivery time and shipping
Allow a delivery time of 3 to 5 working days, from the date of validation of the order and its payment.
For delivery in mainland France, the shipping costs are charged to the order :

• Colissimo: lump sum of 15 € including tax
• Chronopost: The fees are calculated according to the weight of the package, from 21 € TTC for a parcel up to 2kg.

In both cases, the weight of an order can not exceed 30kg.

Braquier reserves the right to change the carrier when shipping the package. However, no change in delivery rate will be made.

ARTICLE 7 – Quality chart

Our products are stored in a dry place, protected from light and at a temperature between + 10 ° C and + 20 ° C.
Any anomaly detected upon receipt of the goods must be mentioned and subject to reservations with the carrier. This complaint must reach us within 48 hours by registered letter with the receipt issued.

ARTICLE 8 - Liability

The Braquier company, in the process of distance selling, is held only by an obligation of means. It can not be held liable for damage resulting from the Internet network such as loss of data, intrusion, viruses, break of the service, or other involuntary problems.

ARTICLE 9 - Personal data

All data collected on this site, by any means whatsoever, is for the reserved use of Société Nouvelle des Établissements Braquier.
At any time, you have a right of access, modification, rectification and deletion of data concerning you (art. 34 of the law "Informatique et Libertés" of January 6, 1978).

In case of litigation, the Verdun Commercial Court has sole jurisdiction.
